Genesis Travel Collective (formerly Genesis Voyages)

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS AND CONDITIONS FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND MAZANAP ENTERPRISES LLC DBA GENESIS TRAVEL COLLECTIVE AND APPLY TO ALL BOOKINGS, PAYMENTS, TRAVEL ARRANGEMENTS, AND RELATED SERVICES PROVIDED OR ARRANGED BY GENESIS TRAVEL COLLECTIVE.

These Terms and Conditions govern the relationship between MAZANAP Enterprises LLC dba Genesis Travel Collective (formerly Genesis Voyages), hereinafter referred to as “Genesis Travel Collective,” “Agency,” “we,” “us,” or “our,” and the traveler, traveler’s parent or legal guardian, and/or any person making, requesting, authorizing, or paying for travel services on behalf of themselves or others, hereinafter collectively referred to as “Traveler,” “Client,” “Passenger,” “you,” or “your.”

By requesting a quote, approving an itinerary, submitting traveler information, paying a deposit, making a final payment, signing an authorization form, or otherwise authorizing Genesis Travel Collective to arrange travel services on your behalf, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you are making a booking for multiple travelers, you represent and warrant that you are authorized to accept these Terms and Conditions on behalf of all persons included in the booking, and you agree to provide a copy of these Terms and Conditions to each such traveler.

Genesis Travel Collective is registered and operates in accordance with applicable seller of travel requirements where required by law. Genesis Travel Collective is not a participant in the California Travel Consumer Restitution Fund and maintains a trust account as required by California law.

2. Role of Genesis Travel Collective; Agency Status

Genesis Travel Collective provides travel advisory, planning, itinerary-design, reservation, and related services. For clients residing in the United States, Genesis Travel Collective may design or curate an itinerary by selecting and arranging travel components from independent third-party Suppliers. Even when Genesis Travel Collective designs or curates an itinerary, the underlying transportation, accommodations, tours, cruise services, activities, insurance products, and other travel services are owned, controlled, operated, and performed by the applicable Suppliers unless Genesis Travel Collective expressly agrees otherwise in writing.

All such travel services are provided by independent third-party suppliers, including but not limited to airlines, cruise lines, hotels, resorts, destination management companies, transfer providers, tour operators, excursion operators, insurance carriers, rail operators, and other travel vendors (collectively, “Suppliers”). Each Supplier is an independent entity with its own terms, conditions, policies, procedures, rules, waivers, and limitations of liability.

Genesis Travel Collective is not responsible for any act, error, omission, negligence, insolvency, bankruptcy, default, delay, cancellation, schedule change, service failure, injury, illness, death, property damage, or other loss caused by any Supplier or by any event beyond our direct control.

For a Traveler whose primary residence is in the United Kingdom, European Union, or European Economic Area, Genesis Travel Collective requires the combined itinerary to be created and operated through a Genesis-approved destination management company or other qualified in-market tour operator (the “DMC/Organiser”). The DMC/Organiser will be identified in the applicable proposal, booking confirmation, or package contract as the party responsible for creating and operating the combined itinerary, and its terms and required traveler disclosures will apply. Genesis Travel Collective acts as the retailer and booking intermediary for that itinerary and may decline or limit a booking if an approved DMC/Organiser cannot be used or cannot provide the documentation or protections required for the Traveler’s market.

Travelers must provide their true primary residence before a proposal is prepared and must promptly notify Genesis Travel Collective of any change. Genesis Travel Collective may rely on that information when determining the booking structure and required disclosures. Nothing in these Terms excludes or limits any mandatory right or responsibility that cannot lawfully be excluded under the law applicable to a particular Traveler or booking.

3. Acceptance of Supplier Terms

In addition to these Terms and Conditions, all travel services are subject to the terms and conditions, tariff rules, passage contracts, cancellation rules, baggage policies, and other contractual terms imposed by the applicable Supplier(s). By authorizing Genesis Travel Collective to make any booking on your behalf, you agree to be bound by all such Supplier terms, whether or not you receive or review them before travel.

It is your responsibility to review all applicable Supplier documentation. If there is a conflict between these Terms and Conditions and any Supplier-imposed term, the more restrictive term may apply to the extent permitted by law.

Genesis Travel Collective does not guarantee the availability, eligibility, or accrual of frequent flyer miles, hotel points, loyalty rewards, upgrades, or other benefits associated with any travel booking. The ability to earn or redeem such benefits is governed solely by the terms and conditions of the applicable airline, hotel, cruise line, or loyalty program. Genesis Travel Collective is not responsible for denied accrual, forfeited points, unavailable upgrades, or changes to loyalty program rules.

4. Booking Information and Traveler Responsibility

You are solely responsible for providing complete, accurate, and timely information for all travelers on the reservation. This includes, without limitation:

You must carefully review all confirmations, invoices, itineraries, and travel documents immediately upon receipt. This includes confirming the accuracy of names, dates, destinations, flights, hotels, room categories, transfers, tours, insurance selections, pricing, and all other booking details.

You must notify Genesis Travel Collective in writing of any errors or discrepancies within seventy-two (72) hours of receipt, or before any earlier Supplier-imposed deadline clearly stated in the applicable communication.

Failure to notify Genesis Travel Collective within this time period, or failure to provide accurate and complete information, may result in additional costs, denied boarding, denied check-in, loss of reservations, or cancellation subject to applicable Supplier terms. To the fullest extent permitted by law, Genesis Travel Collective shall have no liability for losses arising from inaccurate, incomplete, or untimely information provided by you, or from your failure to review and report discrepancies within the required time period.

Traveler names provided for booking must match exactly the legal name shown on the government-issued identification that will be used during travel. For international travel, the name on the reservation must match the traveler’s passport exactly. Name changes after booking may not be permitted, and where permitted, may result in significant Supplier penalties, fare differences, cancellation fees, and administrative fees.

Genesis Travel Collective is not responsible for any loss arising from an incorrect name, incorrect date of birth, incorrect travel document information, or any mismatch between travel documents and reservation details.

6. Passports, Visas, Health Requirements, and Entry Documents

You are solely responsible for obtaining and carrying all required travel documents and meeting all entry, exit, transit, health, customs, and immigration requirements for every destination on your itinerary. This includes, where applicable:

For international travel, Genesis Travel Collective strongly recommends that all passports be valid for at least six months beyond the traveler’s return date unless a destination expressly provides otherwise. Some destinations also require a minimum number of blank passport pages.

Genesis Travel Collective does not undertake any duty to verify your eligibility to enter any country or your compliance with any documentation or health requirement. Any information provided by Genesis Travel Collective regarding passports, visas, vaccinations, or entry requirements is provided as a courtesy only and should not be relied upon as legal or official advice. You are responsible for consulting the relevant government authorities, embassies, consulates, and official health agencies.

Failure to possess required documents may result in denied boarding, denied entry, quarantine, fines, deportation, missed travel components, or cancellation without refund. Genesis Travel Collective shall not be liable for any such loss.

7. Travel with Minors

Adults traveling with minors are solely responsible for ensuring that they carry all documentation required by the destination, airline, cruise line, border authority, and any other relevant authority. This may include birth certificates, adoption records, court orders, and notarized letters of consent from non-traveling parents or legal guardians.

Genesis Travel Collective is not responsible for verifying parental authority, custody status, or required minor travel documentation and shall not be liable for denied boarding, denied entry, or any disruption arising from failure to produce required documents.

8. Quotes, Pricing, and Availability

All prices, quotations, itineraries, and availability are subject to change until the applicable deposit or full payment has been received and the booking has been confirmed by the Supplier. No quoted price is guaranteed until confirmed in writing.

Pricing may change due to many factors outside Genesis Travel Collective’s control, including but not limited to Supplier repricing, inventory changes, occupancy changes, exchange-rate fluctuations, fuel surcharges, taxes, fees, government-imposed charges, or technology errors. Genesis Travel Collective is not liable for pricing errors arising from Supplier systems, third-party booking platforms, or human, clerical, electronic, or typographical error.

If a pricing error or inventory error is discovered after booking, Genesis Travel Collective reserves the right to notify you of the error and offer the option to accept the corrected pricing or cancel the affected reservation, subject to Supplier rules.

9. Deposits, Payments, and Payment Authorization

Genesis Travel Collective accepts payment through its invoicing and payment systems by approved methods, which may include credit card, debit card, or ACH transfer, subject to availability and processing rules.

Unless a different payment schedule is stated in writing for a particular booking, Genesis Travel Collective custom packages and planning arrangements may require a deposit at time of booking and full payment by the date stated on your invoice or booking confirmation. For many custom arrangements, a 50% deposit is required at booking and the remaining balance is due 90 days prior to departure, unless otherwise stated in writing or unless the Supplier requires a different schedule.

Payment plans may be offered at Genesis Travel Collective’s discretion, but failure to make any scheduled payment by its due date may result in cancellation of some or all components of the booking. You are solely responsible for keeping track of all payment deadlines. Genesis Travel Collective may send reminders as a courtesy, but has no obligation to do so and is not liable for missed reminders or missed payment deadlines.

By submitting payment information or signing a payment authorization, you represent and warrant that you are authorized to use the payment method provided and that you authorize Genesis Travel Collective and/or the relevant Supplier to charge the amount due.

Returned payments, chargebacks, ACH reversals, and declined transactions may result in cancellation of the booking and additional recovery or administrative costs to the extent permitted by law.

10. Nonrefundable Services; Custom Package Policy

For U.S.-resident clients, Genesis Travel Collective specializes in customized and curated travel arrangements that may involve negotiated rates, Supplier commitments, planning time, and nonrecoverable expenses. For UK-, EU-, and EEA-resident clients, combined itineraries are created and operated by the identified DMC/Organiser as described in Section 2. In either structure, unless expressly stated otherwise in writing and subject to applicable law, itinerary-design fees, planning fees, Supplier deposits, DMC/Organiser deposits, and related professional services are non-refundable.

Where a Supplier imposes non-refundable terms, those terms will apply in addition to any Genesis Travel Collective policies. A cancellation may therefore result in forfeiture of all amounts paid, up to and including 100% of the total trip cost.

Genesis Travel Collective does not guarantee that any Supplier will issue a refund, travel credit, or exception to its cancellation rules.

11. Final Payment; Failure to Pay

All balances must be paid in full by the final payment due date listed on your invoice, proposal, or booking confirmation. If payment is not received by the final payment deadline, Genesis Travel Collective and/or the Supplier may cancel the reservation in whole or in part. In such event, all deposits and prior payments may be forfeited in accordance with Supplier rules and Genesis Travel Collective policies.

Genesis Travel Collective shall not be responsible for any rate increases, lost space, lost promotions, or cancellation penalties arising from late payment.

12. Changes Requested by Traveler

Any change requested by you after deposit or confirmation, including but not limited to changes in dates, names, travelers, accommodations, transportation, or itinerary components, is subject to availability and approval by the applicable Supplier. Changes may result in revised pricing, loss of promotional benefits, cancellation and rebooking, Supplier penalties, and additional Genesis Travel Collective service fees where disclosed.

Genesis Travel Collective does not guarantee that any requested change can be accommodated.

13. Air Travel; Airline Responsibility

If Genesis Travel Collective assists with air arrangements, or if air arrangements are part of a package, such arrangements remain subject to the airline’s contract of carriage and all airline rules. If you book your own flights separately, you are responsible for providing Genesis Travel Collective with complete and accurate flight details if transfers or coordinated services depend on such flights.

Airlines retain full control over schedules, routing, seating, baggage policies, and operational decisions. Genesis Travel Collective does not control airline operations and is not responsible for schedule changes, overbooking, delays, missed connections, denied boarding, aircraft changes, labor issues, airport congestion, or other airline-related matters.

Any refunds, credits, or compensation related to air travel are issued solely at the discretion of the airline and must be requested directly from the airline in accordance with its policies. Genesis Travel Collective does not guarantee that any airline will issue a refund, credit, or compensation under any circumstances.

Travelers are responsible for complying with all airline check-in times, baggage rules, identification requirements, and security screening requirements. All airline-related claims must be pursued directly with the airline.

14. Accommodations, Room Requests, and Property Conditions

Accommodation descriptions, room renderings, property classifications, and amenity descriptions are based on information supplied by the Supplier and may change at any time without notice. Star ratings and category designations are based on local standards and may differ from standards in the United States.

Specific room locations, views, bedding types, connecting rooms, early check-in, late check-out, and similar requests are requests only unless expressly confirmed by the Supplier in writing. Genesis Travel Collective does not guarantee the availability of any requested room feature or amenity.

Properties may undergo maintenance, renovation, construction, seasonal closures, staffing shortages, or service adjustments with little or no notice. Genesis Travel Collective shall not be liable for inconvenience, noise, closure of facilities, or reduced services arising from such conditions.

15. Tours, Excursions, Transfers, and Activities

Tours, excursions, transportation, transfer services, event access, and activities are subject to the terms, operating schedules, safety requirements, and cancellation rules of the provider. Participation in many travel activities involves inherent risk, including risk of illness, injury, disability, death, property loss, delay, and unexpected conditions.

You voluntarily assume all risks associated with participation in any excursion, activity, or independent arrangement. Genesis Travel Collective is not responsible for the acts, omissions, negligence, or safety standards of any excursion provider or other third party, whether or not such service was reserved through Genesis Travel Collective.

If you have health concerns, mobility limitations, dietary needs, or accessibility requirements, you are responsible for communicating them before booking. Genesis Travel Collective will make reasonable efforts to relay such information to Suppliers but does not guarantee that any Supplier can or will accommodate such requests.

Genesis Travel Collective is not responsible for any travel arrangements, services, or components that are not booked directly through the Agency. If you independently arrange any portion of your travel, including but not limited to airfare, accommodations, transfers, excursions, or insurance, you assume full responsibility for those arrangements. This includes, without limitation, schedule changes, delays, cancellations, missed connections, supplier errors, or additional costs incurred.

Genesis Travel Collective shall have no liability for any disruption, loss, or expense arising from independently booked services and is not responsible for coordinating such services with Agency-arranged travel components. Any assistance provided in connection with independently booked services is provided as a courtesy only and without liability.

16. Health, Fitness to Travel, and Accessibility

You represent that you and all travelers on the reservation are medically and physically fit for travel and that participation in the booked itinerary will not endanger yourself or others. Travelers requiring medical assistance, mobility support, or special accommodation must disclose those needs before booking.

Genesis Travel Collective does not provide medical advice and is not qualified to assess whether a particular itinerary, destination, cruise, tour, or activity is appropriate for your medical condition or accessibility needs. You are responsible for consulting qualified medical professionals as appropriate.

Some Suppliers reserve the right to deny boarding, deny participation, or require a companion where a traveler’s condition may affect safety or operations. Genesis Travel Collective is not liable for any decision made by a Supplier in this regard.

17. Travel Insurance

Proof of travel insurance coverage is required for international travel arranged through Genesis Travel Collective unless Genesis Travel Collective expressly waives that requirement in writing.

Travel insurance is strongly recommended for all travel arrangements and is intended to help protect travelers against certain risks, which may include trip cancellation, interruption, medical emergency, emergency evacuation, baggage loss, delay, and other covered events, subject always to the policy terms.

Genesis Travel Collective may offer, suggest, or facilitate the purchase of travel protection or travel insurance through third-party providers; however, Genesis Travel Collective is not an insurer and does not guarantee the availability, scope, or suitability of any policy. Coverage decisions, exclusions, claim determinations, and reimbursement decisions are made solely by the insurance carrier or plan administrator.

You are solely responsible for reviewing the policy terms, exclusions, pre-existing condition provisions, deadlines, and claims procedures. Genesis Travel Collective is not responsible for denied claims, coverage disputes, or a traveler’s failure to obtain adequate coverage.

18. Cancellations and Refunds

All cancellations must be submitted in writing to Genesis Travel Collective. A cancellation request is not effective until acknowledged by Genesis Travel Collective in writing.

Cancellation penalties are governed by the applicable Supplier terms and Genesis Travel Collective’s own non-refundable planning and custom package policies. Because many travel components are non-refundable from the time of booking, cancellation may result in complete forfeiture of all amounts paid.

Genesis Travel Collective does not issue refunds for unused travel services, voluntary itinerary changes, denied boarding, missed flights, missed cruises, missed tours, late arrivals, early departures, failure to obtain travel documents, health-related inability to travel, or removal from travel services due to misconduct, unless a refund is issued by the Supplier and actually received by Genesis Travel Collective for remittance where applicable.

Where any refund is due, processing times are governed by the Supplier and payment processor and may take several weeks or longer.

19. No Refunds for Unused Services

No refunds will be provided for unused portions of travel arrangements, including but not limited to missed flights, missed transfers, skipped hotel nights, missed excursions, early departure, late arrival, failure to appear, or voluntary non-use of services, unless expressly agreed in writing by the relevant Supplier.

20. Force Majeure and Events Beyond Control

Genesis Travel Collective shall not be liable for any delay, cancellation, loss, injury, damage, additional expense, or failure in performance resulting from any event or condition beyond its reasonable control, including but not limited to:

In any such event, Genesis Travel Collective’s obligations are limited to the recovery and remittance of any refundable amounts actually received from the Supplier, less any non-refundable amounts, fees, or unrecoverable costs, where permitted by law. Genesis Travel Collective shall have no obligation to provide a cash refund where the Supplier offers only a credit, voucher, rebooking option, or no recovery at all.

21. Supplier Insolvency or Bankruptcy

Genesis Travel Collective is not responsible for the financial condition, insolvency, receivership, or bankruptcy of any Supplier. If a Supplier ceases operations, files for bankruptcy, or otherwise fails to provide booked services, Genesis Travel Collective shall not be liable for any resulting loss unless and only to the extent recovery is available from the Supplier, an insurer, or another responsible third party.

For this reason, travel insurance and supplier default coverage should be considered carefully.

22. Traveler Conduct

Travelers are expected to act responsibly, respectfully, and lawfully at all times during travel. Genesis Travel Collective reserves the right to refuse service, decline future bookings, or terminate its relationship with any traveler whose behavior is abusive, threatening, discriminatory, harassing, disruptive, unsafe, unlawful, or disrespectful toward Genesis Travel Collective staff, Suppliers, local communities, or fellow travelers.

Suppliers likewise reserve the right to remove or refuse service to any traveler whose conduct violates their rules or endangers persons or property. In such an event, the traveler shall be solely responsible for all resulting costs and shall not be entitled to a refund from Genesis Travel Collective.

23. Risks of Travel

Travel involves risks that may be greater than those encountered in ordinary daily life. Such risks may include transportation incidents, criminal acts, foodborne illness, water quality issues, accidents, exposure to disease, inadequate medical care, political instability, weather conditions, and other known or unknown hazards.

By traveling, you expressly acknowledge and assume these risks, whether such risks are known, foreseeable, or unexpected. Genesis Travel Collective does not guarantee your safety at any destination, property, or event.

24. Baggage and Personal Property

Genesis Travel Collective is not responsible for lost, stolen, delayed, or damaged baggage or personal property. Claims regarding baggage must be made directly with the airline, hotel, cruise line, transfer provider, or other responsible Supplier. Travelers are encouraged to carry valuables, medications, travel documents, and essential items in carry-on baggage and to obtain travel insurance that includes baggage coverage.

25. Complaints During Travel; Duty to Mitigate

If you experience a problem during travel, you must notify the relevant Supplier immediately and allow the Supplier a reasonable opportunity to address the issue while travel is ongoing. You should also notify Genesis Travel Collective promptly so that we may attempt to assist where appropriate.

Failure to report a problem during travel may reduce or eliminate any right to recovery from the Supplier or any argument that the issue could have been corrected. Genesis Travel Collective is not responsible for complaints raised only after travel where you failed to seek resolution at the time the issue occurred.

26. Billing Inquiries, Chargebacks, and Payment Disputes

You agree that all payments authorized by you are valid, final, and subject to the cancellation, refund, and change policies set forth in these Terms and Conditions and by applicable Suppliers.

Nothing in these Terms waives or restricts any billing-error, chargeback, or payment-dispute right that applicable law or a card-network rule gives you. Before initiating a dispute, you are encouraged to contact Genesis Travel Collective promptly so that we can review the charge and supporting booking records, but contacting us first is not a condition to exercising a non-waivable right.

If a payment dispute is made concerning an authorized charge, Genesis Travel Collective may:

You remain responsible for amounts ultimately determined to be validly owed. Genesis Travel Collective will not impose a fee or penalty merely because you make a good-faith billing-error claim or exercise a protected dispute right.

27. Intellectual Property; Itineraries and Proposals

Original itineraries, proposals, written recommendations, branding, website content, and planning materials created by Genesis Travel Collective remain the intellectual property of Genesis Travel Collective unless otherwise agreed in writing. Materials created or owned by a Supplier or DMC/Organiser remain the property of that party. Genesis-created materials are provided for your personal travel-planning use and may not be commercially reproduced, redistributed, copied, or sold without our written consent. Nothing in this section prevents you from using confirmed travel documents for the trip for which they were supplied or exercising a right that cannot lawfully be restricted.

28. Privacy and Booking Communications

By providing your contact information, you authorize Genesis Travel Collective to communicate with you by email, phone, invoice system, and other reasonable means for transactional purposes related to your inquiry, reservation, payments, travel updates, and customer care. Transactional communications are not marketing messages.

Our collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy available on the Genesis Travel Collective website. The Privacy Policy is incorporated into these Terms by reference. Information necessary to arrange travel may be shared with applicable Suppliers, DMCs/Organisers, and service providers as described in that policy.

29. SMS Communications

If you separately opt in to receive SMS or text communications from Genesis Travel Collective, you consent to receive the categories of messages described at the point of opt-in. Consent to receive marketing texts is not a condition of purchasing travel services. Transactional or service-related texts may be sent where permitted by law and based on the contact preferences you provide. Message frequency may vary. Standard message and data rates may apply.

You may opt out at any time by replying STOP. For support, you may reply HELP or contact Genesis Travel Collective directly at (872) 230-0098.

Mobile information collected in connection with bookings or SMS communications will be handled in accordance with our Privacy Policy. Mobile opt-in data and consent will not be sold or shared with third parties for their own marketing purposes. Information shared with communications service providers will be limited to what is reasonably necessary to deliver Genesis Travel Collective messages and operate the program.

30. Disclaimer of Warranties

To the fullest extent permitted by law, Genesis Travel Collective makes no representations or warranties, express or implied, regarding the suitability, safety, quality, availability, performance, or fitness of any travel service provided by any Supplier. All such services are provided on an “as available” basis by independent third parties.

Genesis Travel Collective disclaims all implied warranties, including implied warranties of merchantability and fitness for a particular purpose, except where such disclaimers are prohibited by law.

31. Limitation of Liability

To the fullest extent permitted by law, Genesis Travel Collective shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of enjoyment, emotional distress, lost profits, lost opportunity, or other intangible losses, arising out of or related to any booking, itinerary, Supplier service, travel disruption, injury, illness, cancellation, delay, or other travel-related event.

Without limiting the foregoing, Genesis Travel Collective shall not be liable for any act, error, omission, injury, loss, accident, delay, irregularity, or damage caused by or arising from any Supplier, traveler, third party, force majeure event, or other cause outside Genesis Travel Collective’s direct control.

Where Genesis Travel Collective is found liable despite the foregoing disclaimers, our aggregate liability shall not exceed the greater of (a) the professional planning fees or service fees actually paid directly to Genesis Travel Collective for the specific booking giving rise to the claim, excluding amounts paid to Suppliers, or (b) five hundred U.S. dollars (US$500).

Nothing in these Terms limits or excludes liability for Genesis Travel Collective’s own fraud, gross negligence, or willful misconduct, or for any liability or remedy that cannot lawfully be limited or excluded.

32. Indemnification

You agree to indemnify, defend, and hold harmless Genesis Travel Collective, its owners, members, officers, employees, agents, contractors, successors, and assigns from and against any and all claims, demands, causes of action, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

33. Informal Dispute Resolution; Governing Law; Arbitration

These Terms and Conditions and any dispute arising out of or relating to these Terms and Conditions, the services provided by Genesis Travel Collective, or any booking arranged by Genesis Travel Collective shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles, except to the extent superseded by applicable federal law.

Before filing arbitration or litigation, the claimant must send written notice describing the dispute and requested relief. The parties will attempt in good faith to resolve the dispute for at least thirty (30) days after receipt of the notice. This informal process does not require either party to miss an applicable limitations period; either party may file as reasonably necessary to preserve a claim.

Except for an individual claim eligible for small-claims court and except where applicable law prohibits mandatory arbitration, any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, the services provided by Genesis Travel Collective, or any booking arranged by Genesis Travel Collective shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures in effect when the claim is filed. The AAA Consumer Due Process Protocol applies. If this clause conflicts with a mandatory requirement of those rules or applicable law, the mandatory requirement controls.

The arbitration will be heard by a single arbitrator. The hearing may occur by video, telephone, documents-only procedure, or in person as permitted by the AAA Consumer Arbitration Rules. A Traveler may choose an in-person hearing in the county of the Traveler’s residence or in Miami-Dade County, Florida, unless the parties agree otherwise. AAA fees and arbitrator compensation will be allocated under the Consumer Arbitration Rules and applicable law.

To the fullest extent permitted by law, the parties waive the right to trial by jury and the right to participate in a class action, collective action, or representative proceeding. Claims must be brought only in the individual capacity of the claimant. The arbitrator may award any individual remedy available in court but may not combine the claims of persons who are not parties to the arbitration.

Judgment on the arbitration award may be entered in any court of competent jurisdiction. Each party will bear its own attorneys’ fees unless a statute or the arbitrator’s award permits otherwise.

You may opt out of this arbitration provision by sending a signed written notice to hello@genesistravelcollective.com or to the address in Section 1 within thirty (30) days after you first accept these Terms. The notice must include your full name, mailing address, email address, and a clear statement that you opt out of arbitration. Opting out will not affect your booking or any other provision of these Terms.

34. Notices

Notices required under these Terms must be in writing. Notices to Genesis Travel Collective must be sent by email to hello@genesistravelcollective.com or by trackable mail to the address in Section 1. Notices to you may be sent to the email or mailing address associated with your inquiry or booking. Email notice is deemed received when sent unless the sender receives a delivery-failure notice; mailed notice is deemed received when delivery is confirmed.

35. Updates to These Terms

Genesis Travel Collective may revise these Terms from time to time. The version in effect when you first pay a deposit or otherwise confirm a booking will govern that booking unless a later change is required by law or you expressly agree to the later version in writing. The effective date shown at the top identifies the current version.

36. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

37. No Waiver

No waiver by Genesis Travel Collective of any right, remedy, or breach shall be deemed a waiver of any other or subsequent breach. A waiver is effective only if made in writing by an authorized representative of Genesis Travel Collective.

38. Survival

Provisions that by their nature should continue after completion, cancellation, or termination of a booking will survive, including payment obligations, intellectual-property protections, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and this survival provision.

39. Entire Agreement

These Terms and Conditions, together with any invoices, booking confirmations, authorization forms, and applicable Supplier terms incorporated by reference, constitute the entire agreement between you and Genesis Travel Collective concerning the subject matter herein and supersede any prior oral or written communications on the same subject, except where Genesis Travel Collective expressly agrees otherwise in writing.
